Terms of Service

These Terms of Service (“Terms”) govern your use of this website and the vehicle rental services offered through it. By accessing the site or booking a vehicle, you agree to be bound by these Terms.

Requirements for Renters

To be eligible to rent a vehicle through our platform, you must meet all of the following conditions:

  • Be at least 21 years old at the time of booking.
  • Phone number and email address.

For US Citizens and Residents

  • A valid driver’s license.
  • Proof of full auto insurance (liability, collision, and comprehensive).
  • A US residential address.

For International Renters

  • A valid foreign driver’s license.
  • Travel auto insurance or US auto insurance coverage (we can assist with options if needed).
  • Temporary US address.

Security Deposit

A refundable security deposit is required for every rental and must be paid before vehicle pickup. The amount typically ranges from $250 to $1,000, depending on the vehicle. The exact deposit amount will be provided before confirming your reservation.

The deposit can be submitted via credit card, debit card, Zelle, or cash, and will be returned using the same method it was received.

Minimum Rental Period

We specialize in long-term rentals, and better rates or discounts may apply for extended bookings. Exact pricing and discounts are displayed during the booking process and may vary by vehicle and duration.

Payment Terms

All rentals must be paid in full before the vehicle is released. We accept major credit and debit cards through our booking platform. Other payment methods (such as Zelle, cash, or invoice) may be accepted upon request.

Prices shown during booking include base rental cost, applicable taxes, and mandatory fees. Optional services or penalties (such as late return or excess mileage) may be charged separately as outlined in the rental agreement.

Mileage Restrictions

A standard mileage limit of 100 miles per day applies to all rentals. For example: a 7-day rental includes 700 miles, a 30-day rental includes 3,000 miles. Any mileage beyond the included limit will result in an extra charge, as specified in the rental agreement. Some vehicles may offer the option to purchase unlimited mileage during the booking process. Availability and pricing vary by vehicle.

Vehicle Delivery

Vehicle delivery is available within Austin and surrounding areas, including nearby cities such as Cedar Park, Leander, Round Rock, Pflugerville, and others. A $60 delivery fee and a $60 return fee apply when choosing delivery to your location.
Delivery must be arranged in advance and confirmed during the booking process.

Prohibited Use

The rental vehicle may not be used for any of the following:

  • Driving under the influence of drugs or alcohol
  • Racing, drifting, off-roading, or any competitive driving
  • Towing or transporting other vehicles, trailers, or heavy equipment
  • Use by unauthorized drivers or individuals without a valid driver’s license
  • Transporting illegal substances or engaging in unlawful activity
  • Commercial or rideshare purposes (e.g. Uber, Lyft, food delivery)
  • Overloading the vehicle with passengers or cargo beyond legal or manufacturer limits
  • Leaving the state of Texas or entering restricted areas without written permission
  • Smoking or vaping inside the vehicle (subject to a cleaning fee)

Violation of any of these restrictions may result in immediate termination of the rental, forfeiture of the deposit, and additional penalties as outlined in the rental agreement.

Tolls, Tickets, and Fuel

  • You are responsible for all toll charges, parking tickets, traffic violations, and other fines incurred during your rental period.
  • Any unpaid tolls or tickets may be deducted from your security deposit or charged to your payment method, along with an administrative fee.
  • The vehicle must be returned with the same fuel level it had at pickup.
  • A refueling fee will apply if the fuel level is lower upon return.

Platform Role

Enginelity.com is a booking platform that connects renters with third-party vehicle owners and rental providers (“Owners”). The platform does not own most of the listed vehicles and is not a direct party to rental agreements.

All rentals are subject to a separate Car Rental Agreement entered into between the renter and the respective Owner of the vehicle. Enginelity may act as a payment processor, communication facilitator, and administrative coordinator, but does not assume ownership or operational responsibility for vehicles unless explicitly stated.

Limitation of Liability and Indemnification

By using this website, you acknowledge and agree that Enginelity LLC (“Enginelity”) and its affiliates are not responsible for any loss, damage, injury, or death that may occur during the use of vehicles rented through our platform. You further agree to indemnify and hold Enginelity harmless from any claims, actions, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your rental, operation, or use of any vehicle booked through our platform.

Bookings and Payments

All reservations must be made through the platform’s online system. By making a booking, you agree to:

  • Provide accurate personal and driver’s license information,
  • Upload proof of full coverage insurance (liability, collision, and comprehensive),
  • Pay the required rental fee and refundable security deposit.

The platform may collect and hold payment on behalf of the Owner, deducting a service commission. You understand that payments processed through the platform are forwarded to the vehicle Owner upon completion of the rental, minus applicable fees.

Cancellation Due to Eligibility Requirements

If a paid reservation is canceled because the renter does not meet the rental eligibility requirements (such as age, valid driver’s license, insurance, or other mandatory conditions), a refund will be issued minus any non-refundable payment processing fees, if applicable. These fees are determined by third-party payment processors and are not retained by Enginelity.

Final Steps and Rental Agreement

After completing your reservation and payment, you will be asked to upload your driver’s license and proof of insurance. A formal Car Rental Agreement will then be generated for electronic signing prior to vehicle pickup. You must sign this agreement to receive the vehicle.

These Terms and any disputes arising from your use of this platform shall be governed by the laws of the State of Texas.
